JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-05-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 325, 308, 504, 34 of the Indian Penal Code.

The prosecution case is that on 18.02.2016 the informant was sitting at his door when the petitioner along with other co-accused came and started abusing. On protest being made the petitioner and others assaulted the informant. The petitioner assaulted on the head of the informant with iron rod and when wife of the informant came to rescue then she was also being assaulted on her leg causing fracture injury. It is submitted by learned counsel for the petitioner that for a petty dispute the accusation has been levelled. There is counter version of the occurrence and three persons from the petitioner's side also received injuries. Only one injury caused to the wife of the informant was found to be

Patna High Court Cr.Misc. No.22474 of 2016 (2) dt.19-05-2016 2/2 grievous which is on the non-vital part of the body. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Khudaganj P.S. Case No. 26 of 2016, pending in the Court of learned Additional Chief Judicial Magistrate, Hilsa, Nalanda. With the observations above, the application stands disposed off.
