2. Learned counsel for the petitioner submits that the present writ petition has been filed against the order dated 06.01.2018 passed by respondent No.2, namely, the District Magistrate, Rohtas by which the petitioner has been terminated from service. Counsel further submits that the said order has been passed according to the provision of the Bihar Government Servants (Classification, Control & Appeal) Rules, 2005 (hereinafter referred to as the 'CCA Rule, 2005'). He fairly submits that the provision of appeal is there under the CCA
Patna High Court CWJC No.8004 of 2018 dt.23-01-2024 2/2 Rule, 2005.
3. As such, this Court disposes off the present petition directing the petitioner to avail the remedy of appeal before the Commissioner concerned within 30 days along with a copy of this order. The appellate authority is directed to pass the final order in this case within 90 days from the date of production of a copy of this order. The delay, if any, in filing the appeal has been directed to be condoned.
