The petitioner has prayed for regular bail in a case registered for the offence punishable under section 394 of the Indian Penal Code.

Prosecution case relates to snatching cash of Rs. 50,000/- and a mobile phone from the pocket of the informant while he was going to purchase machine.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. The name of the petitioner has been disclosed in this by the apprehended co-accused person and nothing incriminating article has been recovered from his conscious possession which shows his involvement in the

Patna High Court CR. MISC. No.64844 of 2022(2) dt.24-02-2023 2/2 alleged offence. Except this, nothing has come against the petitioner. Moreover, similarly situated co-accused namely, Gabbar Rishi has already been granted bail by a co-ordinate Bench of this Court vide order dated 1.12.2021 in Cr. Misc. No. 34477 of 2021. It is further submitted that the petitioner is languishing in judicial custody since 19.7.2021. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Jadia P.S. Case No. 247 of 2020 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-V, Supaul.
