The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 448, 323, 504, 302 of the Indian Penal Code and 27 of the Arms Act.

The prosecution case is that on 01.01.2015 the informant and others were celebrating new year outside the village where for a petty dispute the accused persons started abusing the informant by calling caste name hence the informant and others flee away towards their house. It is alleged that the accused persons variously armed came to the house of the informant started abusing and asked from the informant's father about the informant and others. No.23328 of 2016 (2) dt.24-05-2016 2/2 informant co-accused Pramod Yadav fired on him as a result he fell down when second fire was made by co-accused Jatan Yadav, as a result father of the informant died at spot. It is submitted by learned counsel for the petitioner that accusation of firing is not against the petitioner. Considering the fact that similarly situated co-accused persons have been granted regular bail, it is a case for consideration of prayer for regular bail.

Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Bind P.S. Case No.01/2015, pending before the learned ACJM-VI, Nalanda at Biharsharif.

With the above observation, this application is, accordingly, disposed off.
