Petitioners seek bail in a case registered for the offence punishable under Sections 147, 149, 341, 342, 323, 324, 307 and 302 of the Indian Penal Code.
Allegation against the FIR named accused including these petitioners is to have assaulted the son and nephew of the informant by means of iron rod and lathi with intent to kill them as a result of which, they sustained head injury and became seriously injured. The injured were brought to Sadar Hospital, Sheikhpura fromwhere, they were referred to PMCH, Patna, however, during treatment, son of informant, Golden Kumar
Patna High Court CR. MISC. No.59821 of 2019(3) dt.04-12-2019 2/2 succumbed to injuries.
It has been submitted on behalf of the petitioners that they are innocent and have falsely been implicated in this case. Considering the facts and circumstances of the case and nature of allegation, statement of witnesses recorded during investigation particularly of Police Kumar who took both injured to Hospital in a conscious condition, I am not inclined to enlarge the petitioners on bail at this stage. Hence, the prayer for bail of the petitioners is hereby rejected.
However, the petitioners would be at liberty to renew their prayer for bail after one year in jail custody. (S. Kumar, J) Sanjay/- U T
