The petitioner is apprehending his arrest in connection with Birpur P.S. Case No.20 of 2014 for allegedly having committed the offences under Sections 302, 384/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner, though named in the F.I.R., has no role to play in the occurrence as the story, which has been carved out by the informant, is wholly farfetched and considering the fact that he was not present at the place of occurrence and came subsequently, he could not have seen as to what was happening inside the hut. Learned counsel for the petitioner further submits

Patna High Court Cr.Misc. No.20278 of 2015 (2) dt.30-07-2015 2/2 that similarly situated co-accused Kuldeep Banewar has been extended the privilege of anticipatory bail in Cr.Misc. No.26495 of 2014, vide order dated 2.12.2014. It is also submitted that the petitioner is having no criminal antecedents. Considering the aforementioned submissions and the nature of allegations, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Birpur (Supaul), in connection with Birpur P.S.
