The petitioner seeks bail in a case instituted for the offences under Sections 9, 27, 39(B), 44 and 49(B) of the W.L. Protection Act.
This matter relates to recovery of skin and bone of the tiger. The name of the petitioner has transpired during investigation on the confessional statement of the co-accused. Learned counsel for the petitioner submits that petitioner is in jail since 2.2.2016. He further submits that Padum Narain Chaudhary has been granted bail by this Court vide Cr. Misc. No. 19024 of 2016.
Having considered the facts and circumstances of the
Patna High Court Cr.Misc. No.27239 of 2016 (2) dt.18-07-2016 case, let petitioner, Bhola Sah, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Bagaha, West Champaran in connection with I.F. Case No.9 of 2016, subject to the conditions that (i) one of the bailors shall be a close relative of the petitioner i.e father, mother and brother (ii) If the petitioner is found involved in future in similar type of case the prosecution will be at liberty to make prayer for cancellation of his bail and the court below will pass necessary order including cancellation of bail and (iii) petitioner would participate in the court proceeding and in the event of being absent on two consecutive dates, the court below will be at liberty to cancel the bail bonds of the petitioner.
