JUSTICE PRABHAT KUMAR JHA ORAL ORDER 11-08-2016 Heard the learned counsel for the petitioner, the learned counsel for the informant and the learned Additional Public Prosecutor.
The petitioner apprehends his arrest in Bagaha Pathkhauli P.S. case No.13/2016 under Section 406, 420, 341, 323, 504 of the Indian Penal Code.
The gist of the allegation is that the petitioner mortgaged the land of another person to the informant after taking Rs. 30,000/-.
It is submitted that the petitioner is ready to return the money within 30 days. On such, the learned counsel for the informant did not raise any objection.
Patna High Court Cr.Misc. No.24864 of 2016 (3) dt.11-08-2016 2/2 Considering the fact that petitioner is ready to return the money within 30 days, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Bagaha, West Champaran in Bagaha Pathkhauli P.S. Case No. 13 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
If the petitioner fails to return the money to the informant within 30 days, the learned court below shall cancel the bail bonds of the petitioner.
