Mr.Awadhesh Kumar Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 27-02-2023 Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor.

The petitioner is in custody in a case registered for offence punishable under Section 392 of the Indian Penal Code. It is a case of bank robbery in which Rs.7,51,000/- is looted and the accused persons fled away with the amount. It is submitted that the petitioner has falsely been implicated in this case and on the confessional statement of the co-accused the name of the petitioner came into light and the petitioner is remanded in this case. The petitioner has not been put on test identification parade and no recovery has been made from him. On similar footing co-accused, namely, Ankit Kumar Thakur @ Ankit Thakur, has been granted regular bail in Cr. Misc. No. 32944 of 2022 vide order dated 13.01.2023 by a coordinate Bench of this Court. The petitioner is in custody in this case

The learned Additional Public Prosecutor for the State opposed the prayer for bail.

Considering the aforesaid submissions, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Sakra P.S. Case No. 404 of 2021 to the satisfaction of the Additional Chief Judicial Magistrate, XII, Muzaffarpur (East).
