2. The accused/petitioner apprehending his arrest in connection with Naugachia (Mahila) P.S. Case No. 03 of 2024 registered for the offences punishable under Sections 498(A)/341, 323, 504, 506/34 of the Indian Penal Code.

3. The allegation against the petitioner is to commit mental and physical cruelty upon the informant alongwith other co-accused persons/family members due to nonfulfillment of demand of cash of Rs. 1.5 lacs and one motorcycle as dowry.

It is submitted by learned counsel appearing on behalf of the petitioner that the allegation qua committing mental and physical cruelty is appearing very much general and omnibus against this petitioner. It is submitted that no any demand of dowry as alleged for cash of Rs. 1.5 lacs and for one motorcycle was ever raised by this petitioner. It is submitted that out of temperamental issues, the petitioner as per his personal law solemnized another marriage and, therefore, the present false implication was raised.

5. Learned APP, duly assisted by learned counsel Mr. Rajesh Kumar, appearing on behalf of the informant, while opposing the prayer of bail submitted that this petitioner solemnized another marriage.

6. In view of aforesaid factual submissions and by taking note of fact as allegation qua committing mental and physical cruelty appears very much general and omnibus against this petitioner, accordingly, above named petitioner, in the event of his arrest or surrender before the learned trial Court, within a period of four weeks of the order, is directed to be released on bail furnishing bail bond of Rs. 10,000/-

Patna High Court CR. MISC. No.63069 of 2025(3) dt.11-02-2026 3/3 (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Naughachia, Bhagalpur/concerned Court, where the case is pending in connection with Naugachia (Mahila) P.S. Case No. 03 of 2024 subject to the conditions as laid down under Section 482(2) of the BNSS.
