JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 12-07-2016 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case under Sections 420, 406 and 120B of the Indian Penal Code and BPTD Act, 2002.

The informant alleged in the F.I.R. that Woods Pharmaceuticals Ltd. and Woods Laboratories Ltd. have started the work of Non-banking organization. The owners of the firm and the employees have induced the depositors and allured them to deposit the money, on assurance of heavy returns. In the process, a large number of persons were cheated of their money. The petitioner submits that he is only an employee of the firm and prior to the institution of the case, he resigned from the Directorship of the firm. He submits that in other cases, he has been given benefit under the provisions of Section 41 of the

Patna High Court Cr.Misc. No.25036 of 2016 (3) dt.12-07-2016 2/2 Cr.P.C. by the police.

Having regard to the facts and circumstances of the case, in the event of arrest or surrender before the court below within five weeks from today, the above named petitioner be released on bail on furnishing bail bond of Rs.25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kishanganj in connection with Kishanganj P.S. Case no. 08 of 2014 subject to the conditions as laid down under Section 438 (2) Cr.P.C. with the further condition that one of the bailors would be in form of cash deposit and the other would be a local person. The petitioner would not physically absent for two consecutive dates at stretch, till charge is framed, failing which his bail bonds would be cancelled.
