JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 20-09-2017 Heard learned counsel for the petitioner and the State. Petitioner is in custody in connection with Konch P.S. Case No. 155 of 2015 for an offence under sections 302/201/34 of the Indian Penal Code.

Counsel for the petitioner submits that similarly circumstanced other co-accused Shankar Choudhary has been granted bail by this court in Cr. Misc. No. 27536 of 2016 vide order dated 8.12.2016. He further submits that the case of the petitioner is identical to the case of the Shankar Choudhary who has been granted bail by this court.

Considering the fact that this court has granted bail to other co-accused on consideration of the case diary wherein witnesses have stated that the deceased was a drunkard and on

in view of the aforesaid facts and circumstances, the court is inclined to enlarge the petitioner, named above, on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. IIIrd, Gaya or the successor court, in connection with Konch P.S. Case No. 155 of 2015 on the condition that one of the bailors should be family members of the petitioner and the petitioner will cooperate in the trial and will not, in any manner, influence the evidence or the witnesses.
