JUSTICE MOHIT KUMAR SHAH ORAL ORDER 12-09-2019 The present writ petition has been filed for directing the respondents to remove the encroachment over the government land bearing Survey Khata No. 1662 of the Public Works Department, situated near Lila Sah Ke Pokhra, Chapra, Siwan.
In case the petitioner is seeking removal of encroachment over the government land, he is required to approach the Circle Officer, Daraundah, District-Siwan under the provisions of the Bihar Public Land Encroachment Act, 1956 (hereinafter referred to as the 'Act, 1956') for redressal of
Patna High Court CWJC No.18289 of 2019(2) dt.12-09-2019 2/2 his grievances.
Having regard to the facts and circumstances of the case, the present writ petition stands disposed off with liberty to the petitioner to approach the Circle Officer, Daraundah, District-Siwan by filing appropriate complaint under the provisions of the Act, 1956 and in case such an application/complaint is filed, the Circle Officer, Daraundah, District-Siwan shall take appropriate action in accordance with the provisions of the Act, 1956.
The writ petition stands disposed off on the aforesaid terms.
