The petitioners are apprehending arrest in a case registered for the offences punishable under Section 47a of the Excise Act.

From a paltry firm huge quantity of country made liquors were recovered when it is alleged that petitioner and another escaped from the scene. The informant also claimed that the place of seizure is under the control of the accused persons including the petitioners.

It is submitted by learned counsel for the petitioners that there is nothing on record to suggest that the place of seizure is under the control of the petitioners and seizure was

The aforesaid facts constitute good ground for consideration of prayer for regular bail.

Let the learned Court below consider the prayer for regular bail of the petitioners, if the petitioners surrender within a period of six weeks in connection with Excise Case No. 21 of 2015, pending before the learned Chief Judicial Magistrate, Motihari, East Champaran.

With the above observation, this application is, accordingly, disposed off.
