JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-11-2017 The petitioner seeks regular bail in connection with Laxmipur P.S. Case No. 106 of 2017, registered for offences punishable under Sections 120(B) and 122(A) of Indian Penal Code and Section 3 an 4 of Explosive Substance Act and Section 16, 17, 18, 19, 20 and 21 of UPA Act.

Prosecution case is that police on secret information of some terrorist activities raided the place and from petitioner one bomb and detonator was recovered.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case due to village politics and in fact he was not present at the place of occurrence rather he had gone to Jamui court along with his wife to file a complaint. Further he has no criminal antecedent and has been in judicial

Patna High Court Cr.Misc. No.49252 of 2017 (2) dt.09-11-2017 custody since 08.06.2017.

Learned counsel for the State opposed the prayer for bail. Having heard both sides, considering the fact and circumstances of the case and nature of allegation, I am not inclined to release the petitioner on bail rather this application is disposed of with direction to the court below to release the petitioner on bail to his own satisfaction once charge is framed in this case.
