JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a complaint case in which process has been directed to be issued after cognizance being taken for the offences punishable under Sections 420,406 and 323 of the Indian Penal Code.
It is alleged that petitioner no. 1 executed an agreement in favour of the complainant for executing sale deed with regard to the land and received Rupees five lacs. Petitioner nos. 2 and 3 are witnesses to the agreement deed. Subsequently, petitioner no. 1 executed sale deed in
Patna High Court Cr.Misc. No.29929 of 2015 (2) dt.28-07-2015 2/2 faovur of petitioner no. 4.
It is submitted by the learned counsel for the petitioners that the complainant failed to make payment of the consideration amount and after lapse of agreement period the sale deed was executed in favour of petitioner no. 4. More over, the complainant has filed a title suit.
Considering the nature of accusation, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Patna city in connection with Complaint Case No. 457 C of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
