JUSTICE MOHIT KUMAR SHAH ORAL ORDER 15-07-2021 The instant case has been taken up for consideration through the mode of Video Conferencing in view of the prevailing situation on account of COVID-19 Pandemic, requiring social distancing.

The present petition has been filed for quashing the order dated 18.05.2019, passed by the Sub-Divisional Officer, Hajipur, whereby and whereunder the licence of the fair price shop of the petitioner has been cancelled.

At the outset, the learned counsel for the petitioner, in presence of Sri Alok Ranjan(AC to AAG 5) seeks to withdraw the present petition in order to enable the petitioner to file an appeal against the aforesaid order dated 18.05.2019. Accordingly, the present writ petition stands disposed of as not pressed, however with liberty to the petitioner to file appropriate appeal against the aforesaid order dated 18.05.2019 and in case, an appeal is filed within a period of four weeks from today, the same shall be considered by the appellate authority on merits without being impeded by the issue of limitation and disposed of within a period of 08 weeks, thereafter.
