2. The petitioner is in custody since 23.06.2023 in connection with Baisi P.S. Case No. 257/2023 registered for the offence punishable under Sections 8/20(b)(ii)(B) of the NDPS Act.

3. As per the prosecution case, 4.5 kg Ganja has been recovered from a Bus. The petitioner along with other coaccused was arrested.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He further submits that the petitioner has no concern with the alleged recovery of Ganja. The petitioner has no criminal antecedent.

Patna High Court CR. MISC. No.66505 of 2023(2) dt.16-10-2023 2/2 He further submits that similarly situated co-accused Bidhan Chandra Chaudhary has already been granted bail by a coordinate Bench of this Court vide order dated 30.08.2023 passed in Cr. Misc. No. 55718 of 2023.

Considering the facts and circumstances of the case, the the period of custody and also the fact that similarly situated co-accused has been granted bail by a co-ordinate Bench of this Court, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, NDPS Act, Purnea in connection with Baisi P.S. Case No. 257/2023.

6. The petitioner is directed to mark his attendance in Kharik Bazar police station, Bhagalpur on the 1st Sunday of each month.

7. Let a copy of the order be communicated to the Superintendent of Police, Bhagalpur through FAX/e-mail forthwith for compliance of the order.
