JUSTICE SUDHIR SINGH ORAL ORDER 16-09-2016 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case instituted for the offences under Sections 341, 323, 324 and 307/34 of the I.P.C. Later on, Section 302 of the I.P.C. was also added. The allegation is that the accused persons including the petitioners had held the hands of the maternal grand son of the

Patna High Court Cr.Misc. No.32447 of 2016 (3) dt.16-09-2016 informant, namely, Ghanshyam Kumar and assaulted him with knife in his stomach causing bleeding injuries. It has been submitted on behalf of the petitioners that petitioner Pramod Sharma @ Pramod Kumar Sharma is in custody since 21.3.2016 and petitioner Sonu Ansari is in custody since 25.2.2016 and the charge sheet has been submitted in the present case. The petitioners have got no criminal antecedents. There is no allegation of tampering of witnesses alleged against the petitioners. No injury is said to have been caused by the petitioners on the deceased. The main allegation is against the coaccused, namely, Shashi Kumar. The death is said to have been taken place after 18 days of the occurrence.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioners above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Siwan/Additional Chief Judicial Magistrate IX, Siwan in connection with Nautan P.S. case No.20 of 2016.
