JUSTICE SUDHIR SINGH ORAL ORDER 07-12-2016 Heard learned counsel for the Petitioner and the State. The Petitioner seeks bail in S.T. No.210 of 2015/ 413 of 2016 arising out of Roh P.S. case No.83 of 2014 instituted for the offence under Sections 302/34 of the Indian Penal Code, pending in the court of learned Additional Sessions Judge V, Nawada.

Earlier the bail application of the petitioner was rejected vide Annexure-1 to the present application.

A report was called for from the trial court regarding the stage of the trial. It has been reported that only the official witnesses are to be examined on behalf of the prosecution and the trial is expected to be concluded within a period of two months. Considering the aforesaid facts and circumstances, I am

Patna High Court Cr.Misc. No.32996 of 2016 (5) dt.07-12-2016 2/2 not inclined to grant bail to the petitioner. The same is rejected. The Trial Court is directed to take all necessary steps to conclude the trial.

The District Magistrate, Nawada and the Superintendent of Police, Nawada are also directed to ensure that the official witnesses on behalf of the prosecution are produced on the date fixed by the trial court so that the trial could be concluded at the earliest.
