The sole petitioner, apprehending his arrest in Bihariganj P.S. Case No.91/2016 registered for the offence under Section 47 A of the Bihar Excise Amendment Act, 2016, has prayed for grant of bail in the event of his arrest or surrender. By way of referring to the F.I.R., learned counsel for the petitioner submits that it is a case of the informant itself that a pick-up Van was brought at the door of one Ajay Kumar Singh and other persons have also disclosed that the said vehicle was brought by Ajay Kumar Singh, from which vehicle huge quantity of foreign liquor was recovered and even though the petitioner has been made accused only on the ground that a secret
Patna High Court Cr.Misc. No.34634 of 2016 (2) dt.08-09-2016 2/2 information has been received by the informant that one vehicle was lying near the door of the petitioner, in which liquor was hidden.
In view of the fact disclosed in the F.I.R. as well as nature of accusation, let the petitioner, Bidur Singh , in the event of his arrest or surrender within six weeks from today , be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Udakishunganj in connection with Bihariganj P.S. Case No.91/2016, subject to conditions as laid down in Section 438(2) of the Code of Criminal Procedure. (Rakesh Kumar, J) NKS/- U T
