JUSTICE SUDHIR SINGH ORAL ORDER 11-01-2017 Heard learned counsel for the petitioner and learned APP for the State.
The petitioner is apprehending his arrest in a case registered under Sections 304B, 201 and 120B of the Indian Penal Code.
Allegation is that the accused persons including the petitioner committed murder of the daughter of the informant due to non-fulfilment of dowry.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The
Patna High Court Cr.Misc. No.34573 of 2016 (4) dt.11-01-2017 2/2 petitioner has falsely been implicated in the present case. The prosecution witnesses in their statements in paragraphs 8, 10, 11, 12, 34, 38, 53 and 72 of the case diary have not supported the prosecution case. The death of the deceased is said to have taken place due to illness. After investigation the police has submitted final form.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Complaint-cum-Protest case No. C1/52 of 2013 arising out of Nanpur P.S. case No.78 of 2012, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
