2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 137(2), 96, 352, 351(2) and 3(5) of the BNS.

3. The case of the prosecution is that the minor daughter of the informant has gone to shop but when she did not return for a considerable time, she was being searched. The informant came to know that the petitioner has kidnapped her minor daughter for the purpose of marriage. During course of investigation victim was recovered. From the perusal of the order of the learned trial court it is clear that the statement of the

No.64705 of 2025(2) dt.18-09-2025 2/3 victim was recorded under Sections 180 and 183 of the BNSS and she has stated in her statements that she was having affair outside marriage with the petitioner and wanted to marry him but her family was not ready, so she left her home with the petitioner and reached at Katihar and there she married the petitioner. After that she went to Bokaro. As per victim, she married with the petitioner and started living together for some days.

4. Learned counsel for the petitioner has submitted that Annexure-2 is the medical report of the victim. From perusal of Annexure-2 it will transpire that the Doctor has opined that the age of the victim is between 20-21 years. Learned counsel for the petitioner has also submitted that it is a case of affair outside marriage and the victim is major. The petitioner is a man of clean antecedent and is in judicial custody since 26.04.2025.

5. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer of bail to the petitioner.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with
