JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-09-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341 and 323 of the Indian Penal Code and section 3(1)(x) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act. It is alleged that on 5.1.2015 the informant being teacher of High School, was abused by the petitioner being a co-teacher of the same school. The reason for the occurrence is that the informant complained against the petitioner through the Block Education Officer.
It is submitted by the learned counsel for the petitioner that for a petty dispute the accusation has been levelled and the
Patna High Court Cr.Misc. No.34641 of 2015 (2) dt.01-09-2015 2/2 informant retracted from the initial version and has filed a petition to that effect before the learned court below. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Masaurhi, Patna in connection with Masaurhi P.S. Case No. 5 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
The learned court below shall be at liberty to cancel the bail bonds of the petitioner in case the petitioner defaults in regular cooperation of the investigation.
