====================================================== CORAM: HONOURABLE MR. JUSTICE SANDEEP KUMAR ORAL ORDER 23-09-2025 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. The petitioner seeks bail in connection with Hajipur Excise P.S. Case No. 223 of 2025 registered for the offence punishable under Sections 30(a)(b),(c) of the Bihar Prohibition and Excise Amendment Act, 2018.

3. There is recovery of 15 litres of illicit liquor.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The petitioner is in custody since 21.07.2025 and claims clean antecedent.

5. Learned APP for the State has vehemently opposed the prayer of regular bail of the petitioner.

6. Considering the facts and circumstances of the case

Patna High Court CR. MISC. No.63799 of 2025(2) dt.23-09-2025 2/2 and the submission of learned counsel for the petitioner, this application for regular bail stands allowed.

7. Accordingly, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise, Court No. 1 cum Additional District and Sessions Judge, Vaishali at Hajipur/concerned Court below in connection with Hajipur Excise P.S. Case No. 223 of 2025 subject to the condition that:- (i). The petitioner is directed to mark his attendance in Gangabridge Police Station on every Sunday of each month. Failure to do so, will result in cancellation of bail bonds of the petitioner.

(ii). Before accepting the bail-bond of the petitioner, the court below will verify the antecedent of the petitioner. If the petitioner is found having clean antecedent, the bail-bonds of the petitioner shall be accepted. If the petitioner is found having criminal antecedent(s), his bail-bonds shall not be accepted by the court below.
