2. The petitioners seeks bail in connection with Dinara P. S. Case No. 50 of 2025, dated 09-02-2025 instituted for the offence punishable under Sections 191(2), 191(3), 190, 118(1), 118(2), 109, 351(2), 352, and 132 of the Bharatiya Nyaya Sanhita, 2023 as well as Section 27 of the Arms Act.

3. The prosecution case, in short, is that on 09.02.2025 at 4:10 P.M., when ASI Amit Kumar of Dinara Police Station, along with other police personnel, reached the Radha Krishna Temple, he found that a firing and altercation had taken place between two parties, in which one person

The names of the accused persons came to light through information given by the village Chaukidar and local villagers, based on CCTV footage. The police also seized a TVS Apache motorcycle bearing registration number BR44T-1250.

4. Learned counsel for the petitioners submits that the petitioners are innocent and he has been falsely implicated in the present case. It is further submitted that the First Information Report ( for short 'FIR') has been lodged against ten named accused persons, including the petitioner, as well as 5-6 unknown persons. It is submitted that no specific allegation has been made against the petitioners rather, the accusation is general and omnibus in nature. No incriminating articles have been recovered from the possession of the petitioners. Petitioners are in judicial custody since 21.06.2025. It is also submitted that the charge sheet has already been filed in this case. It is further submitted that co-accused have already granted bail vide order dated 05.05.2025 in Cr. Misc. No. 26095 of 2025 and vide order dated 30.04.2025 in Cr. Misc. No. 24279 of 2025 by the Co-ordinate Benches of this Court.

5. Learned A.P.P. has opposed the prayer for bail.

6. Having considered the facts and circumstances of

No.65193 of 2025(2) dt.17-09-2025 3/3 the case and submissions of learned counsel for the parties, let the petitioners be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM, Bikramganj, Rohtas in connection with Dinara P. S. Case No. 50 of 2025.
