JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-09-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147,341,323,379,427 and 504 of the Indian Penal Code and section 3(1)(x) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act.

It is alleged that the accused persons came to the shop of the informant, damaged the laptop and took out four thousand five hundred rupees and four mobiles. It is further alleged that the accused persons assaulted the informant when the husband of Mukhia Nathuni Sah came to rescue then he was also assaulted. It is submitted by the learned counsel for the petitioners

Patna High Court Cr.Misc. No.36452 of 2015 (2) dt.09-09-2015 2/2 that the injury has been found to be simple in nature and there is counter version of the occurrence. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

It is submitted by the learned Spl. APP that the occurrence took place at a public place in full public view. Let the learned court below consider the prayer for regular bail of the petitioners considering the fact that both sides have received injury and there is counter version of the occurrence in case the petitioners surrender within six weeks from today in connection with Kaluahi P.S. Case No. 48 of 2015 pending in the court of learned J.M. Ist Class, Madhubani.

This application is disposed of with the aforesaid observation/direction.
