JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 20-09-2017 Heard the learned counsel for the petitioners as well as the learned A.P.P. for the state.

In this application for anticipatory bail the petitioners apprehend their arrest in connection with Raghunathpur P.S. Case No. 113 of 2017 for the offences punishable under sections 147, 149, 341, 323, 354 and 504 of the I.P.C.

Allegedly, the petitioners and other co-accused assaulted the deaf and dumb son of the informant with lathi and iron rod and when the husband of the informant came for rescue then the petitioners and others came and assaulted with lathi and rod on the left hand of husband of the informant causing injury and further they abused and tried to outrage modesty of the

Submission is of false implication and that no offence under section 354 of the I.P.C. is made out, there is no specific allegation against any one in this regard, No injuries have been caused on the vital part of the body and as such the petitioners deserve sympathetic consideration.

The learned A.P.P. opposes prayer for pre-arrest bail of the petitioners.

In the facts and circumstances stated above, the petitioners, in case of their arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of A.C.J.M-VIII, Siwan in connection with the aforementioned case, subject to the condition as laid down under section 438 (2) of the Cr.P.C.
