JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-10-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,323,307 and 379/34 of the Indian Penal Code.

It is alleged that the petitioner and co accused Nitish Singh attempted to dash through truck when the informant was travelling on motorcycle. It is further alleged that the petitioner assaulted the informant with iron rod causing bleeding injury on his right knee and co accused Nitish Singh assaulted the informant with fists and slaps when the petitioner snatched gold chain and cash of rupees one thousand from the informant. It is submitted by the learned counsel for the petitioner that the informant was driving auto rickshaw of the petitioner at

Patna High Court Cr.Misc. No.36595 of 2015 (7) dt.29-10-2015 2/2 New Delhi and due to some wages dispute the accusation has been levelled. It is further submitted that for the occurrence of 28.10.2014 the FIR was registered on 7.12.2014. Though injury on the knee of the informant has been found to be grievous but no explanation has been given for delayed lodging of the FIR. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Sitamarhi in connection with Belsand P.S. Case No.154 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
