Petitioners seek bail in a case registered for the offences punishable under Sections 302,201,34 of the Indian Penal Code.

Petitioners are mother-in-law and younger brother of the husband of the victim of murder. Marriage was solemnized in the year 2009 and the victim was blessed with two children aged about 08 years and 06 years respectively. Allegation is that due to non-fulfillment of demand of a motorcycle, the victim was being tortured by the inlaws off and on and her death was committed for that reason and the dead body was disposed of.

Patna High Court CR. MISC. No.61470 of 2019(2) dt.01-10-2019 2/2 Submission is that there is no eye witness of the occurrence. Husband is already in jail. The informant and others had participated in the cremation of the dead body and thereafter just to pressurize, false case has been lodged. Considering the entire facts of this case, let the petitioners, above named, be released on bail after completion of investigation on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Barauli Police Station Case No.185 of 2019, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioners shall fully cooperate with the investigation of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
