JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 10-09-2015 Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the State. This application for grant of anticipatory bail arises out of Parasbigha PS Case No.61 of 2015, disclosing offences under Sections 147, 148, 149, 341, 323, 307 and 504 of the Indian Penal Code.

Learned counsel for the petitioners submits that the present Parasbigha PS Case No. 61 of 2015 is a counter-blast of a case earlier instituted by the side of the petitioners being Parasbigha PS Case No. 60 of 2015. He has further submitted that allegation against these petitioners is of assaulting wife of the informant, Srimati Devi. However, no grievous injury has been found on her person on examination by the doctor. He has also

Patna High Court Cr.Misc. No.36936 of 2015 (2) dt.10-09-2015 2/2 submitted that the allegation of assault is on one Rabindra Kumar, son of the informant. But there is no allegation against these petitioners so far as the assault on Rabindra Kumar is concerned. In view of the submissions as above, this application is allowed. Let the petitioners above named, in the event of their arrest or surrender before the Court below within six weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Chanda Kumar, learned Judicial Magistrate 1st Class, Jehanabad, in Parasbigha PS Case No.61 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall liable to be cancelled.
