JUSTICE SUDHIR SINGH ORAL ORDER 26-10-2016 A supplementary affidavit has been filed on behalf of the petitioners. Same may be kept on the record. Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case registered under Sections 399, 402 and 414 of the Indian Penal Code. As per self statement of the Inspector-cum S.H.O. Marhowrah Police Station that he got a secret information that some miscreants were planning to commit dacoity in Sonepur and Doriganj.When he along with some other officials reached at Silhauri, they saw 7-8 persons in a silver colour Sumo vehicle and on seeing police party they tried to flee away. The police chased but out of 7-8 persons only the petitioners were caught. They also

Patna High Court Cr.Misc. No.37041 of 2016 (3) dt.26-10-2016 2/2 disclosed the names of their associates. On demand of paper regarding vehicle they could not produce any paper. It has been submitted on behalf of the petitioners that the petitioners are in custody since 15.03.2016. Charge sheet has been submitted in this case. There is no allegation of tampering with the witnesses alleged against the petitioners. The petitioners have falsely been implicated in the present case. There is no substantive material to suggest the implication of the petitioners in the present case. Other co-accused have already been granted bail vide Cr. Misc. No.26523/16 and Cr.Misc. no. 19021 of 2016 by this Court.

On behalf of the State, it has been submitted that the petitioners are named in the FIR.

Considering the aforesaid facts and circumstances of the case, let, above named petitioners, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-II, Saran, Chapra in connection with Marhowrah P.S.Case No. 111 of 2016.
