This is an application for bail in connection with Warisaliganj P.S.Case No. 192 of 2014 registered for the offences punishable under Sections 304B and 120B of the Indian Penal Code.

Allegation against the petitioner is dowry death and he is said to be husband of deceased.

Submission of learned counsel for the petitioner is that when he came to village he saw that deceased was suffering from ailment and he has taken her to hospital for treatment and during course of treatment she died, which fact is supported by the statements of witnesses in case diary and even in viscera report no poisonous substance was found and he is in custody since 29.6.2017.

Patna High Court Cr.Misc. No.46194 of 2017 (3) dt.11-10-2017 2/2 Heard learned APP also, who could not controvert the above submission.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-II, Nawada, in connection with Warisaliganj P.S.Case No. 192 of 2014, subject to the following conditions :- (1) One of the bailors shall be a local person having sufficient immoveable properties in the jurisdiction of court concerned, (2) Petitioner shall co-operate in trial and appear on each and every date fixed in court and failure to appear on two consecutive dates without any genuine reason or without permission of court, his bail bond shall be liable to be cancelled.
