2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 354, 379/34 and other allied sections of the Indian Penal Code.
3. As per the prosecution case, on 8.2.2022 around 12.00 in the noon, when the informant was at his house, all the accused persons variously armed, abused and assaulted with danda on his head. When, wife of the informant came to save him, her clothes was torn and golden chain and cash was taken away by them.
4. Both parties are pattidars. There is counter version vide Bhagwan Bazar Police Station Case No. 50 of 2022 and in order to save their skin from the aforesaid case, this false case has been lodged. The allegation of offences under sections 354 and 379 of the IPC are attributed to other persons. Petitioner is lady and has got clean antecedent.
6. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner,
Patna High Court CR. MISC. No.66913 of 2023(2) dt.18-10-2023 2/2 mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate I, Saran at Chapra in Bhagwan Bazar Police Station Case No. 51 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
