2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 147/148/149/341/323/307/354/379/504 of the Indian Penal Code and Section 27 of the Arms Act.
3. The case of the prosecution, in short, is that the petitioner along with other accused persons armed with iron rod, pistol, sword, etc., assaulted the informant and others due to which three persons sustained grievous injury.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. Learned counsel for the petitioner also submits that, due to petty dispute, an altercation took place between the parties. It is also submitted that the nature of assault is general and omnibus and it has also been submitted that both sides have sustained injuries. The learned

No.70889 of 2025(2) dt.09-10-2025 2/3 counsel for the petitioner has further submitted that co-accused Lal Babu Yadav and Shyam Babu Singh, who were having similar nature of allegation, have been granted bail by a learned Coordinate Bench of this Court vide Cr. Misc. No. 89224 of 2024 and Cr. Misc. No. 15917 of 2025 respectively. It has been submitted that the case of this petitioner stands on similar footing. Moreover, the petitioner is languishing in judicial custody since 12.06.2025.
5. Learned APP appearing for the State has opposed the prayer of regular bail stating that the petitioner has two criminal antecedents.
6. Considering the aforesaid facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Sigori P.S. Case No. 134 of 2023 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Danapur, District - Patna/ concerned Court.
