JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 04-10-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.
The petitioner wants to renew his prayer for bail which was earlier rejected vide orders dated 11.05.2016 and 12.04.2017 passed in Cr. Misc. Nos. 13127 of 2016 and 13311of 2017, on the ground that the petitioner is suffering in custody since 13.11.2015 and there is no specific allegation against the petitioner and only on suspicion he has been implicated. The learned A.P.P. opposes prayer for bail of the petitioner by submitting that during investigation two eye witnesses have also supported regarding involvement of the petitioner in the crime.
In the facts and circumstances stated above, finding no
Patna High Court Cr.Misc. No.44776 of 2017 (2) dt.04-10-2017 2/2 good ground for reconsideration of prayer for bail, again prayer for bail of the petitioner stands rejected in connection with Assaon P.S. Case No.91 of 2015 pending in the court of C.J.M. Siwan. However, the learned trial court is again directed to expedite the trial and to conclude the same preferably within a period of two months from the date of receipt/production of a copy of this order, failing which the petitioner may be at liberty to renew his prayer for bail.
