The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 323, 341, 328, 504, 506 and 34 of the Indian Penal Code and section 4/5 of the Prevention of Witch Practices Act.
As per the prosecution case, when the informant was at her daughter's home, one Salkhan Marandi called the informant through mobile phone and asked her to come soon with documents of land. It is further alleged that when she came there, all the accused persons including petitioner abused and pressurized her to drink obnoxious substance. When Babua Hansda, Babua Marandi and Sukh Marandi came there to save her, they were also assaulted by the accused

It is submitted that petitioner is innocent and has committed no offence. Allegation is general and omnibus. Petitioner is non else than own elder son of informant and due to land dispute the alleged occurrence took place. All the sections are bailable except section 328 of IPC and 4/5 of the Prevention of Witch Practices Act which are super addition in order to make the offence grave. Petitioner claims clean antecedent. Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Belhar P.S. Case No. 143 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
