Heard learned counsel for the petitioner and learned counsel for the Accountant General, Bihar and learned counsel for the Punjab National Bank.
In view of the categorical statements made by Mr.
Patna High Court CWJC No.9444 of 2018(3) dt.01-06-2020 2/3 Kumar Priya Ranjan, learned counsel representing the Punjab National Bank (respondent no. 5), this writ application is being disposed of with the consent of the parties.
While learned counsel for the petitioners has submitted that the limited prayer of the petitioners is to direct the respondents to pay the outstanding family pension amount due from January 2007 to July 2015 as the mother of the petitioners started getting family pension only from the month of August 2015 and the amount for the aforesaid period remained due, as also to transfer the cash amount of Rs.12,000/- along with its interest which was lying in the credit balance of the account of the father of the petitioners in the bank, it is a categorical statement of Mr. Kumar Priya Ranjan, learned counsel for the Bank that Bank has calculated the entire arrears and is going to deposit the entire amount of Rs.5,62,119/- in the account of the petitioners by Friday i.e. 05.06.2020.
Learned counsel for the Bank has in fact stated that he is aware of the fact that the nominee Kalawati Devi has died and the entire payment is to be made either in the joint account of the petitioners or in the account of one of the petitioners with consent of the other petitioners. Such formalities shall also be completed by Friday.
Patna High Court CWJC No.9444 of 2018(3) dt.01-06-2020 3/3 This writ application is, thus, being disposed of by recording the undertaking given on behalf of the Punjab National Bank. The Punjab National Bank (respondent no. 5) shall make payment of the entire amount as stated above positively by Friday i.e. 05.06.2020 in the manner stated hereinabove. In case the petitioner would have any grievance with respect to the quantum of the amount paid by the Bank it will be open for them to request the Bank to furnish calculationsheet showing the calculations of the amount paid to the petitioners and on such request respondent 5 shall make available the calculation-sheet within a period of two weeks thereafter. Still if the petitioner(s) will have any grievance with respect to the calculations, they would be at liberty to bring it to the notice of the respondent no. 5 who will consider the same and will take an appropriate decision thereon within a reasonable period.
