JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-07-2020 Heard learned counsel appearing for the petitioners as well as learned Additional Public Prosecutor for the State through video conferencing.

Petitioners apprehend their arrest in connection with Naokothi P.S. Case No.37 of 2019 registered for the offences punishable under Sections 304(B), 201 and 34 of the IPC. Petitioner No.1 happens to be mother-in-law whereas petitioner no.2 happens to be Gotani of the deceased. Although, there appears to be general allegation of assault along with illegal demand as well as torture, but no specific overtact has been attributed against these petitioners.

Submission on behalf of the petitioners is that petitioners do not have any concern with the affairs of husband

Furthermore the submission on behalf of the petitioners is that the deceased was chronic patient of abdominal ailment and prior to her death she got her treatment by a local doctor but, unfortunately, she could not be saved and after her cremation the informant lodged this false case with an ulterior motive.

Considering the aforesaid facts and circumstances of the case as well as submission of the parties, let petitioners in the event of their arrest/surrender within six weeks from the date of receipt of this order to the Court concerned, shall be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) within two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Begusarai or his successor in connection with Naokothi P.S. Case No.37 of 2019, subject to conditions as laid down under Section 438(2) of the Cr.P.C. (Hemant Kumar Srivastava, J) Prakash Narayan /- U T
