2. The petitioner apprehends his arrest in Excise P.S. Case No. 1446 of 2023 registered for the offences punishable under Section 30(a), 32(3) of the Bihar Prohibition and Excise Act, 2016 (Amended 2018-22), pending in the Court of learned Special Judge, Excise Court No. II, Muzaffarpur.

3. After some arguments, learned counsel for the petitioner seeks permission to withdraw this application.

4. Permission is granted.

5. Accordingly, the instant application is dismissed as withdrawn.

6. However, if the petitioner surrenders before the learned Court below within a period of six weeks from today

Patna High Court CR. MISC. No.76777 of 2023(2) dt.02-12-2023 2/2 and seeks regular bail, the learned Court below would pass the order, preferably, on the same day, without being prejudiced by this order, considering the fact that nothing has been recovered from conscious possession of the petitioner.
