2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Section 30(a) of the Bihar Prohibition and Excise Act, registered in connection with Amdabad P.S.Case No.158 of 2024.

3. Acting swiftly on a tip-off regarding illegal transportation of foreign liquor by the accused persons, including the petitioner, the informant, along with other police personnel, reached the informed place and seized the vehicle, wherefrom 102 litres of foreign liquor was recovered.

4. The learned counsel for the petitioner has submitted that the entire allegation is false and concocted.

Patna High Court CR. MISC. No.68332 of 2024(2) dt.01-10-2024 2/2 Nothing has been recovered from the conscious possession of the petitioner, having clean antecedents. He is in prison since 15.08.2024. It is submitted further that other co-accused persons, having similar allegation have been granted bail by this Court in Cr. Misc. No. 66616 of 2024 under order dated 25.09.2024.

5. Considering the above facts and circumstances, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Excise Court No.1, Katihar in connection with Amdabad P.S.Case No. 158 of 2024, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
