This contempt petition is being filed to initiate a contempt proceeding for violation of the order dated 13.09.2012 passed by the learned Single Judge in CWJC No. 14281 of 2012, titled as Ran Vijay Singh Karn Vs. Rajya Sahkari Bhumi Vikas Bank Ltd. & Ors. in which the order has been passed to pay all the admitted dues of the petitioner within two months from the date of receipt/production of a copy of this
Patna High Court MJC No.581 of 2018(4) dt.07-12-2022 2/3 order, so far the unadmitted dues are concerned, the said Authority pass appropriate order in that regard within two months from the date of receipt/production of a copy of this order in connection with the deducted amount of Rs. 84045/-, amount of interim relief Rs. 9324/-, sanction amount of salary Rs. 191507/-, revised pay arrears Rs. 75000/- and sanctioned amount of D.A. as well as Ist and 2nd time bound promotion amount Rs. 70000/- claimed by the petitioner. The operative portion of the order, subject matter of the present application, is extracted as under:- "5. In the said circumstances, this writ petition is disposed of with a direction to the Managing Director of Rajya Sahkari Bhumi Vikas Bank Ltd., Patna to pay all the admitted dues of the petitioner within two months from the date of receipt/production of a copy of this order."
In response to the petition, the respondents have placed on record the order dated 08.01.2013 passed on the petitioner's application, in terms of the direction issued by this Court. If the order is not acceptable to the petitioner, it cannot be said that the respondents have committed any contempt. There was no adjudication and determination of rights or quantification of the any amount.
As such, we dispose of the present application
Patna High Court MJC No.581 of 2018(4) dt.07-12-2022 3/3 reserving liberty to the petitioner to agitate the issue, should the need so arise.
Interlocutory application, if any, shall also stand disposed of.
