The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 364, 498(A)/34 of the Indian Penal Act and Section 3/4 of the Dowry Prohibition Act.

Allegation against the petitioner along with coaccused persons of torturing and making cruelty upon the sister of the informant due to non-fulfillment of dowry demand. It is further alleged that they also committed murder of informant's sister and disappeared her body.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is father-in-law of the victim/informant's sister due to

Patna High Court CR. MISC. No.63432 of 2022(2) dt.23-02-2023 2/2 which he has falsely been implicated in this case. As a matter of fact, the victim girl is trace-less till date. The petitioner has no concern mess and business of the victim as well as her husband and lives separately from them. There is no specific overt-act against the petitioner. The full responsibility to maintain his wife is upon husband of the victim who is already in judicial custody. The petitioner has got no criminal antecedent. He is languishing in judicial custody since 26.9.2021. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Sheikhopur Sarai P.S. Case No. 84 of 2016 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-III, Shekhpura.
