JUSTICE SUDHIR SINGH ORAL ORDER 11-10-2017 Heard learned counsel for the petitioner and learned counsel for the State.

The present application has been filed for modification of the order dated 01.08.2017 passed in C.W.J.C. No.11134 of 2012 by which the petitioner was directed to file an appeal before the State Appellate Authority within 30 days with liberty to file separate application for grant of interim relief during the pendency of appeal within a period of 10 days from filing of such appeal but due to some unavoidable reason the petitioner was

Patna High Court MJC No.2614 of 2017 (3) dt.11-10-2017 2/2 unable to come to Patna as there was heavy flood in his area. It is prayed on behalf of learned counsel for the petitioner that further time may be extended, so that the petitioner could file appeal and stay application before the State Appellate Authority.

Considering the submissions made on behalf of learned counsel for the petitioner and the grounds mentioned in the modification application, further 30 days time is granted to the petitioner to file an appeal before the State Appellate Authority from today.

The order dated 01.08.2017 passed in C.W.J.C. No.11134 of 2012, is modified to the extent as indicated above. The modification application is, accordingly, disposed of.
