The petitioner seeks bail in a case under Section 409 and other sections of the Indian Penal Code, section 7 of the E.C. Act and under section 39, 192, 192(A), 123, 124 and 125 of the M. V. Act.

300 bags of rice were recovered from a tractor bearing registration No. BR-05G-9429. The petitioner is delivery boy of Mid Day Meal. The petitioner is alleged to have sold the Mid Day Meal.

It is submitted that no shortage was found. The petitioner is in jail since 22.06.2015.

Considering the facts aforesaid and the nature of

Patna High Court Cr.Misc. No.41572 of 2015 (2) dt.10-09-2015 2/2 allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, East Champaran, Motihari in Patahi P.S. Case No. 101/15.
