The Petitioner who is in custody seeks bail in connection with Kotwali (Barari) P.S. Case No. 80 of 2016 registered for the offence punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act. It has been submitted on behalf of the petitioner that the petitioner is not named in the FIR. The informant is the eye witness of the occurrence and in the FIR he has named Pankaj Shah and Ajay Kumar Shah, who have committed the murder of the brother of the informant. It has been further submitted that the name of the petitioner has transpired during investigation, and he has been made accused on the basis that he

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge, Bhagalpur, in connection with Kotwali (Barari) P.S.
