2. The petitioner is in custody in connection with Ramnagar P.S. Case No. 522 of 2022 registered for the offence punishable under Sections 379, 401 and 413 read with Section 34 of the Indian Penal Code.

3. As per allegation in the FIR, the informant parked his motorcycle bearing registration no. BR22-W-4332 in front of the house of one Sanjeev Prasad and went to teach students, which has been stolen.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in the case and the allegation against the petitioner is general in nature. He further submits that nothing has been recovered from the conscious possession of the petitioner and he has not named in the FIR. He

Patna High Court CR. MISC. No.67005 of 2024(2) dt.18-01-2025 2/2 next submits that petitioner is not put on Test Identification Parade and there is no any eye witness of the alleged occurrence. He lastly submits that chargesheet has been submitted against the petitioner. Petitioner is in custody since 09.02.2023.

5. Learned APP for the State opposes the prayer for bail of the petitioner.

Considering the facts and circumstances of the case, period of custody and similarly situated co-accused persons namely Kanhaiya Mahto, Saif Ali Ansari and Manoj Ram have been granted bail by this Court and a Co-ordinate Bench of this Court in Cr. Misc. Nos.70490 of 2023, 12894 of 2024 and 52233 of 2024 vide orders dated 06.11.2023, 28.02.2024 and 20.07.2024, respectively let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-Ist Bagaha, District-West Champaran in connection with Ramnagar P.S. Case No. 522 of 2022.
