01-02-2016 Heard Sri Nagendra Kumar Singh, learned counsel for the petitioner and Sri S.N.Shukla, learned Addl. Public Prosecutor. The petitioner, who apprehends his arrest in Khodawandpur (Chhaurahi O.P.) P.S. Case no. 168 of 2014 registered for the offence under Sections 302/34 of the Indian Penal Code, has prayed for grant of anticipatory bail. It was submitted by learned counsel for the petitioner that F.I.R. was lodged against unknown. He submits that the petitioner was not involved in the case, however; subsequently only on confessional statement of one of the co-accused, the petitioner has been made accused.
Earlier, in this case, case diary was called for, which has been received and kept on record.
Patna High Court Cr.Misc. No.41011 of 2015 (4) dt.01-02-2016 2/2 Sri Shukla, learned Addl. Public Prosecutor, opposing the prayer for bail, submits that sufficient material has come against the petitioner to show that he was one of the main conspirator in the case.
In view of facts and circumstances, I do not find any ground to extend the privilege of anticipatory bail. The petitioner stands dismissed.
