This application has been filed on behalf of the petitioner for Modification of order dated 15.07.2019 passed in Cr. Misc. No. 15388 of 2019 by which the petitioner was granted pre-arrest bail in the event of his arrest or surrender within six weeks from the date of passing of the order on furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-III, Barh, Patna in connection with Salimpur P.S. Case No. 249 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C., on
Patna High Court CR. MISC. No.59262 of 2019(2) dt.29-01-2020 2/2 showing the receipt of deposit of Rs. 65,850/- in the concerned Bank, on protest.
Learned counsel further submits that while petitioner approached to the Central Bank of India to deposit Rs. 65,850/- within time, but he was informed that he has to deposit Rs. 84,000/- due to that reasons, he could not deposit the amount within the stipulated time and later on, petitioner deposited Rs. 84,000/- till 27.08.2019.
In such view of the matter, the time to surrender of petitioner, as per order dated 15.07.2019 passed in Cr. Misc. No. 15388 of 2019, is further extended by two weeks from today in connection with the aforesaid case.
Accordingly, the modification application is allowed and the order dated 15.07.2019 passed in Cr. Misc. No. 15388 of 2019 is modified to the above extent.
