Petitioner seeks bail in a case registered for the offences punishable under Section 414 of the Indian Penal Code, Sections 25(1-b)a, 26, 35 of the Arms Act, Sections 20(B), 23, 25, 27A and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985.
Submission is that recovery of narcotics and firearm is alleged from the house of co-accused Umakant Dubey. Umakant Dubey disclosed name of the petitioner and others including Jitu Choudhary as co-culprit. Jitu Choudhary has already been allowed bail by a Coordinate Bench of this Court vide order dated 13.09.2018 passed in Cr. Misc. No. 43918 of 2018 (Annexure-2).
Considering the facts aforesaid, let the petitioner,
Patna High Court CR. MISC. No.65134 of 2019(2) dt.04-11-2019 2/2 above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Tandwa Police Station Case No. 03 of 2016, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
